OGDENSBURG — State police on Sunday charged Michael J. Murphy, 33, of Ogdensburg with first offense DWI and aggravated DWI, both class-U misdemeanors. He was also charged with drinking alcohol while driving, an infraction.
Troopers allege that they stopped Mr. Murphy after he failed to keep right or signal. He was found to have a BAC of 0.27.
State law says a BAC of 0.08 percent or higher constitutes intoxication, while 0.18 percent is the state threshold for aggravated DWI.
Mr. Murphy was released on an appearance ticket.
