GOUVERNEUR — State police on Saturday charged Bradley S. Harmer, 52, of Gouverneur, with operating a vehicle with a BAC of over 0.08 percent and first offense DWI, both class-U misdemeanors.

Troopers say that Mr. Harmer was involved in a motor vehicle accident on Sept. 22 when he drove his ATV off the road and into an embankment on Orebed Road in Fowler. Troopers say they received the toxicology report recently, which showed Mr. Harmer to have had a BAC of 0.14 percent, and then arrested him.

State law says a BAC of 0.08 percent or higher constitutes intoxication.

Mr. Harmer was released with an appearance ticket returnable to the Town of Fowler Court.
